This Consumer Health Data Privacy Policy explains how MY HOMA, LLC ("MyHoma," "we") handles consumer health data — personal information that is linked or reasonably linkable to you and identifies your past, present or future physical or mental health status — under the Washington My Health My Data Act and similar laws in other states, such as Nevada and Connecticut. It adds to our Privacy Policy (myhoma.com/privacy-policy), which covers everything else.
1. THE CONSUMER HEALTH DATA WE COLLECT
- What you tell Homa about how you feel, your mood, your stress, your sleep or your mental health, in a call or in the chat, and the notes and memories she keeps from it.
- Mood check-ins, journal entries and your answers to the first questions about what you want from MyHoma.
- Readings of the tone of your voice or your expression (such as "sad" or "smiling"), only if you switch them on; they are used for that moment and not stored.
- Safety (crisis) records: when something said shows signs that someone may be in danger, a record of that event, with the words that triggered it and the time.
2. WHY WE COLLECT IT, AND HOW WE USE IT
Only to provide the Service you ask for — to talk with you, to remember what matters to you if you agree, and to suggest a small next step — and to keep people safe. We do not use consumer health data for advertising, and we do not sell it.
3. WHERE IT COMES FROM
- From you: what you say and write in the app.
- From your device: your microphone during a call, and your camera while you turn it on.
- From our own systems: the notes, memories, tone readings and safety records they make from your conversations.
4. WHO RECEIVES IT
We share consumer health data only with these processors, under contract and only to provide the Service, and with authorities when the law requires it:
- Anthropic (Claude), with your permission: it writes Homa's answers and checks what you say for signs that someone may be in danger. It receives what you say, as words, with what Homa remembers that bears on it, and, while your camera is on, stills from your camera.
- Google (Gemini), with your permission: Homa's ear and voice. It receives your voice during a call, the text of Homa's replies and, while your camera is on, stills from your camera, and on the website it writes down what you say.
Our hosting provider (Hostinger) rents us the server that relays the audio and video of calls and stores our encrypted off-site backups. Everything else is kept on servers we operate. We do not sell consumer health data, and we share it with no third party or affiliate other than the processors listed above. Authorized MyHoma staff may read conversations to check quality and safety and to look into reports. We do not use geofences around places that provide health care.
5. YOUR CONSENT
We collect consumer health data only with your consent: your yes to Homa's AI companies (section 4) before your first conversation, and your yes to saving conversations when you create an account. You can withdraw your yes to Homa's AI companies at any time in Settings. Saving is part of having an account: you withdraw it by deleting your account.
Safety records are the one exception. Every conversation is checked for signs of danger, and a safety record is kept even before you have an account (in the preview), because it exists to protect you and others — so that crisis resources are shown at once and our staff can review what happened — and because the law asks us to keep and report such events. When you delete your account, your name and your words are removed from it.
6. YOUR RIGHTS
- Confirm and access: whether we collect, share or sell your consumer health data, and a copy of it (Settings, then Download my data).
- The list of who received it: the processors in section 4; write to us for the list that applies to you.
- Delete it: Settings, then Delete my account, or single memories in Settings › Memory (Homa stops using a deleted memory at once; its text, and any memory kept for safety, goes when you delete your account). Deleting does not reach our processors: what they received is kept or deleted under their own terms with us (our Privacy Policy, section 5, says more); on request we tell you which of them received your data.
- Withdraw consent: in Settings.
To use a right, email [email protected] from your account's address; we may ask you to confirm it is you, and we answer within 45 days. If we turn down a request, reply with "Appeal" and we will decide again within 45 days; if you are still not satisfied, you may contact your state's attorney general (in Washington, through the Attorney General's online complaint form).
